Data Protection Policy and Data Protection Remarks

1. Subject matter

Thank you for visiting the Trading Hub Europe GmbH website and for your interest in our company.

The protection of your personal data (e.g. name, business e-mail address and telephone number, hereinafter referred to as "data") is very important to us and a responsibility that we take very seriously. For this reason, we conduct our web activities in accordance with the laws on data protection and data security. The following regulations provide information about the type, scope and purpose of the collection, processing and use of personal data. This privacy policy only refers to our website.  

2. Collection and use of your data

 (a) General

 Personal data that you provide to us with your consent will only be collected, processed and used for the purposes communicated to you.

Without separate express consent, the collection, processing and use of your personal data can only take place if the collection, processing or use of the data:

 is required for the preparation, negotiation and performance of a contract with you,

  • is for a purpose directly related to the purpose for which you gave your consent to the collection, processing and use of your personal data,
  • is necessary due to a legal obligation or governmental or court order,
  • is necessary to establish or protect legal claims or to defend against legal action, or
  • serves to prevent abuse or other unlawful activities. With regard to the use of our website, the type, scope and purpose of the collection, processing and use of your personal data will depend on whether you access "generally accessible information" (see (a) below) or "not generally accessible information and services" (see b + c below) on the pages of our website.

 (b) Use of the website to retrieve generally accessible information

For the purpose of accessing generally accessible information on the website of Trading Hub Europe GmbH, i.e. information that can be accessed by anyone without special registration or authorisation, it is generally not necessary for you to provide us with your data (with the exception of the IP address of your computer).

Whenever you access our website for said purpose, we will automatically collect and use only such data that is transmitted to us by your internet browser, namely:

  • Date and time of the access to one of our web pages
  • Name of the retrieved file
  • Amount of data transferred and notification of whether the retrieval was successful
  • Description of the type of browser used
  • The last page you visited
  • Your IP address

This information will be evaluated for internal statistical purposes (e.g. frequency of page visits, increase in the number of page visits [traffic volume], error analysis, etc.), but the individual user will remain anonymous. The IP address will be deleted after the end of the visit to our website.

We do not collect any further data from you in this context. You alone decide whether you provide us with further data, for example in connection with a survey or for the execution of a contract.

 (c) Use of the website to access information and services that are not generally accessible

Insofar as you use the information and services which are not generally accessible and which are offered by us on our website pages, namely those which can only be accessed via the Customer Portal or the portal for the use of the Virtual Trading Point, it is necessary that, in addition to the data mentioned in (a) hereinabove, you provide us with such data in non-anonymised form as is necessary for the performance of the contract, in particular such data for the purpose of your identification, for the provision of services and/or for the technical handling and processing as part of the services offered (e.g. name, official postal and e-mail addresses).

In addition, we will log all of the activities ("log data") carried out by you when you use the Customer Portal or the portal for the use of the Virtual Trading Point, insofar as such activities lead to a change in the information and data stored on the portals. The foregoing will be done exclusively in order to uncover any behaviour of the users that is in breach of the contract (e.g. uploading of information that is incorrect either as a result of wilful misconduct or gross negligence).

When you use the Customer Portal provided by us or the portal for the use of the Virtual Trading Point, we will store your name, your username, your official e-mail address and your log data for a reasonable period of time even after termination of the respective portal usage relationship in order to uncover any behaviour of the users contrary to the terms of the contract.

3. Cookies

We use cookies to help us administer this website. Cookies are small files which are saved to your computer's hard drive when you visit our website and are used for future visits.

The purpose of the cookies we use is to enable continued identification of your computer the next time you visit our website, as well as when you switch between different pages on our website, and to store log-in information when you use the online portals.

By means of the settings in your browser, you yourself can determine whether cookies are to be stored while you are using the website of Trading Hub Europe GmbH. However, for the smooth use of all functionalities of our website, it is necessary for technical reasons to allow use of the above-mentioned cookies. 

4. Withdrawal of your permission

Your personal data is protected by technical and organisational security measures against accidental or intentional manipulation, loss, destruction or access by unauthorised persons.

The responsible body within the meaning of the German Federal Data Protection Act (BDSG) and at the same time the service provider within the meaning of the German Telemedia Act (TMG) is Trading Hub Europe GmbH, cf. the imprint. You have a right to free information about your stored data and, if applicable, a right to correction, blocking or deletion of this data.
